What is a DMV Hold on your license?

Failure to deal with a traffic ticket in a timely manner will result in the court contacting the California Department of Motor Vehicles (DMV) in order to have your license suspended or a DMV Hold placed on it until you resolve your traffic ticket.

A DMV hold on your driver's license results in one or both of the following:-

  • The inability to renew your license
  • A suspended license.
Traffic Ticket Due Date

traffic ticket due dateWhen you are given a traffic ticket, you will see a court date is listed at the bottom of the traffic ticket. If you fail to take any action on this ticket and you do not appear in court by the due date that appears on the bottom of your ticket, you will be charged with a Failure To Appear (VC 40509.5 holds).

Don’t expect a reminder from the Court

dmv hold letter from traffic courtMany people fail to appear in court because they are waiting for a letter from the Traffic Court. Unfortunately many times the court does not send a courtesy letter about your ticket and many people fail to appear in court by the due date listed at the bottom of their traffic ticket.

The consequences of Failure To Appear

When you fail to appear in court or deal with your traffic ticket by the due date on your traffic ticket, the Court will contact the DMV and if applicable to the charge, a DMV hold may be placed on your driver’s license by the Department of Motor Vehicles, resulting in the inability to renew your license and/or a suspension or revocation of your license privileges to your California driver's license.

Oftentimes people have no idea there is a DMV hold on their license until they try to renew their license or renew their insurance and then they find out their license is suspended or cannot be renewed.

What is a DMV Abstract?

DMV Abstracts are no longer available

Starting April 6, 2015 the Traffic Clerks at ALL LOS ANGELES SUPERIOR COURTHOUSES STOPPED SELLING DMV ABSTRACTS. –This is a very disappointing decision by the Los Angeles Superior Court. THIS WILL NOW MOST LIKELY MAKE IT HARDER AND MORE EXPENSIVE FOR YOU TO CLEAR UP YOUR LICENSE.

A DMV Abstract used to be available from the court to help clear up FTAs or Holds on your license. A DMV abstract was basically an email from the traffic court to the DMV informing the DMV that you are now taking care of your traffic ticket so that consequently the DMV would remove the hold or Failure to Appear (FTA) on your suspended license allowing you to get your license back.

As stated above, all Los Angeles Superior Courthouses have stopped selling DMV Abstracts as of April 6, 2015.

Note - if you have already seen a Judge and plead guilty or no contest, and you failed to pay your fine or do your community service by the due date, and the court says your traffic ticket is now a "failure to pay": This means the only way you can get your license back is to pay the fine that GC Services (or other collection agency) is charging you. WE CANNOT HELP YOU get your license back if you have already seen a Judge and failed to pay the fine or do the community service by the due date and your ticket status is "failure to pay".
